A Liberal man who was living with Nichole Volden, aka Nichole Brown, last year is finally facing arraignment on crimes allegedly committed in April of 2013.

Billy Brown had originally been charged with five counts of aggravated indecent liberties with a child, one indecent solicitation of a child, one count of aggravated criminal sodomy, one count of lewd and lascivious behavior, one count of sexual exploitation of a child under 14 and two counts of aggravated intimidation of a victim or witness.

His first arraignment was scheduled on Oct. 31, 2013, in Seward County District Court, but it has been delayed since.

Brown was then bound over for arraignment at a preliminary hearing on March 7, according to Seward County Attorney Don Scott.

“He was bound over for everything except one count of indecent liberties with a child,” Scott said. “He was bound over on three other counts.”

Scott defined the process of Brown’s hearing on March 7.

“It’s a probable cause hearing where the state presents evidence to establish probable cause that he committed the crime,” Scott explained. “And if we’re successful, they’re bound over for arraignment.”

Brown’s arraignment is set for 11:30 a.m. April 24.

Brown faces even more charges from another similar alleged crime.

“Then there’s another case that he made his first appearance on March 17,” Scott said. “It’s one count of sexual exploitation of a child (under 14).

“This is an additional case,” Scott added.

Brown is currently in jail, according to Scott, and Brown’s preliminary hearing on this third case is scheduled for 2 p.m. May 19.

Volden was sentenced last month on two counts of sexual exploitation of a child but had her sentenced reduced to 24 months of probation.
